1. Acceptance and Binding Agreement

These Terms & Conditions (“Terms”) constitute a legally binding contract between each visitor or user (“you”) and Recoveris AG, Poststrasse 24, 6300 Zug, Switzerland (“we,” “our,” or “us”).

Browsing, accessing, or utilizing the Recoveris AG website (referred to as “Site” or “Platform”) or any services offered through it (collectively, “Services”) confirms your understanding and acceptance of these Terms. These provisions apply to all individuals who interact with our Site in any capacity.

Disagreement with any portion of these Terms requires immediate discontinuation of Site use. Ongoing use constitutes continuous acceptance of both these Terms and our Privacy Policy, which is incorporated by reference. When accessing our Site on behalf of an organization or entity, you confirm that entity also accepts these Terms.

Recoveris maintains the right to update these Terms periodically at its discretion. Changes become effective upon posting to this page, and continued Site usage following such updates indicates acceptance of the revised Terms.

2. Authorized Usage and Limitations

Recoveris AG provides a restricted, personal, non-transferable permission to access and utilize the Site solely for gathering information and submitting legitimate inquiries through designated communication channels.

All content found on the Site—including but not limited to text, interface elements, visual designs, photographs, videos, illustrations, digital assets, data structures, and software code (collectively, “Materials”)—remains the exclusive property of Recoveris and content partners, protected under intellectual property statutes worldwide.

Users explicitly agree not to:

  • Duplicate, adapt, reformat, distribute, or create derivative works from any portion of the Site
  • Deploy automated technologies or programs to extract data from the Site
  • Examine or test the Site’s security framework or seek vulnerabilities
  • Place excessive demands on technical infrastructure
  • Disrupt the intended functionality of the Site

Recoveris expressly reserves the authority to:

Recoveris AG bears no responsibility for technical inaccuracies, interruptions, malfunctions, delays, or system failures of the Site, nor for any consequential losses stemming from Site unavailability.

3. Proprietary Rights Protection

All Materials presented on the Site constitute intellectual assets owned by or licensed to Recoveris AG and receive protection under copyright, trademark, and additional intellectual property regulations. The Recoveris name, brand identity, and all associated identifiers, product designations, service marks, and distinctive elements are protected trademarks belonging to Recoveris or its affiliates.

Unauthorized utilization of these protected elements is prohibited without explicit written authorization from Recoveris AG. Furthermore, users must not remove, obscure, or alter any proprietary notices appearing on any Materials accessed through the Site.

Any unauthorized exploitation of the Site or its Materials may constitute violations of intellectual property statutes and could result in regulatory penalties or legal proceedings.

4. Behavioral Standards

When utilizing the Platform, users commit to refraining from:

  • Conducting activities that violate applicable laws or regulations, or that are harmful, threatening, abusive, or otherwise objectionable
  • Misrepresenting identity or falsely indicating affiliation with any person or organization
  • Disrupting the operational integrity of the Platform or connected networks

Recoveris AG maintains the right to investigate potential violations of these standards and implement appropriate measures, including content removal, account termination, and referral to appropriate authorities.

5. External Resources and Connections

The Platform may feature connections to external websites, tools, and services not maintained or controlled by Recoveris. These connections are provided solely for convenience and do not represent endorsement, verification, or approval of content presented by these external sources.

Users acknowledge and accept that:

  • Recoveris AG bears no responsibility regarding availability, precision, or content quality of external websites
  • Interaction with external websites occurs at the user’s own discretion and is subject to their respective terms of service
  • Recoveris AG assumes no liability for damages or losses resulting from reliance on content, products, or services available through external websites

6. Warranty Exclusions

THE PLATFORM AND ALL MATERIALS, INFORMATION, AND SERVICES PROVIDED THEREON ARE FURNISHED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY NATURE. RECOVERIS AG EXPLICITLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSES, TITLE, AND NON-INFRINGEMENT.

RECOVERIS AG PROVIDES NO ASSURANCE THAT: (A) THE PLATFORM WILL SATISFY SPECIFIC REQUIREMENTS; (B) THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION OR ERROR; (C) INFORMATION OBTAINED THROUGH THE PLATFORM WILL BE ACCURATE OR DEPENDABLE; OR (D) THE QUALITY OF ANY SERVICES, INFORMATION, OR MATERIALS ACQUIRED THROUGH THE PLATFORM WILL FULFILL EXPECTATIONS.

ANY MATERIALS OBTAINED THROUGH USE OF THE PLATFORM ARE ACCESSED AT THE USER’S OWN RISK, AND THE USER BEARS SOLE RESPONSIBILITY FOR ANY SYSTEM DAMAGE OR DATA LOSS RESULTING FROM SUCH ACCESS.

7. Liability Constraints

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNDER NO CIRCUMSTANCES SHALL RECOVERIS AG, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, PARTNERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

(A) ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE PLATFORM;
(B) ANY CONDUCT OR CONTENT OF THIRD PARTIES ON THE PLATFORM;
(C) ANY MATERIALS OBTAINED FROM THE PLATFORM; AND
(D) UNAUTHORIZED ACCESS TO OR ALTERATION OF TRANSMISSIONS OR DATA,

REGARDLESS OF THE FORM OF ACTION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF RECOVERIS AG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

8. Indemnity Obligations

Users agree to protect, defend, and hold harmless Recoveris AG, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising from or connected with:

  • Breach of these Terms
  • Utilization of the Platform or Services
  • Violation of any third-party rights
  • Any materials submitted, posted, or transmitted through the Platform

This defense and indemnification commitment survives termination of these Terms and use of the Platform and Services.

9. Miscellaneous Provisions

These Terms represent the complete understanding between users and Recoveris AG concerning use of the Platform and Services, superseding all previous communications or agreements.

Should Recoveris AG fail to enforce any right or provision within these Terms, this shall not constitute a waiver of such right or provision. If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the parties agree that the court should interpret the provision to reflect the parties’ intentions, with all remaining provisions continuing in full effect.

Users may not transfer or assign these Terms, by operation of law or otherwise, without prior written consent from Recoveris. Recoveris may freely assign or transfer these Terms without restriction.

These Terms shall be governed by and interpreted according to the laws of the jurisdiction where Recoveris operates, without regard to conflict of law principles. Users consent to the exclusive jurisdiction and venue of courts in that jurisdiction for any disputes arising from these Terms or use of the Platform.
